1. Introduction

Welcome to Hazra Solutions We operate an online platform that connects customers/users with service providers ("Service Professionals" or "Vendors"). By using our website and mobile application, you agree to comply with these Terms & Conditions.  
PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE PLATFORM.  

2. Definitions

• Customer/User: Any individual or entity who uses the Platform to avail services.
• Service Professional (Vendor): Independent professionals or businesses registered on our Platform to offer services.
• Platform: Our website, mobile application, and any other digital services provided by Hazra Solutions
• Se rvices: Anything purchased through this platform.  
   

3. Scope of Services

• The Platform facilitates Users in discovering and booking services offered by independent Service Professionals.
• We do not directly provide services but only act as an intermediary between Users and Vendors.
• All transactions between Users and Vendors are solely their responsibility.
• We are not responsible for Vendor compliance, licensing, or product defects.
• We are just the facilitating platforms, all warranties and guarantees fall under vendor obligations.
• Any claims or complaints related to defects, claims, or warranties must be raised with the respective vendor.  
   

4. User Obligations

By using our Platform, you agree to:

• Provide accurate and complete information during registration.
• Use the Platform only for lawful purposes.
• Not engage in any fraudulent activities or misuse of services.
• Abide by all applicable laws and regulations.
• User is responsible for any misuse of their account.  
   

4.1. Prohibited Activities by Customers

• Fraudulent Transactions: Using fake identities, stolen credit/debit cards, or false details to make purchases.
• Chargeback or Payment Fraud: Intentionally filing false chargeback/refund claims after receiving goods/services.
• Spreading Malware or Hacking Attempts: Using the platform to spread viruses, malware, or attempt unauthorized access.
• Misuse of Return/Refund Policy: Repeatedly ordering and returning used/damaged products with the intent to cheat.
• Resale of Products Without Authorization: Buying from platforms and reselling without proper license/permissions (esp. for restricted goods).
• Money Laundering / Suspicious Transactions: Using e-commerce accounts for illegal fund transfers or money laundering.
• Fake Reviews & Misrepresentation: Posting false reviews, ratings, or testimonials to mislead other consumers.
• Abusive or Illegal Use of Platform: Using accounts for harassment, threats, abusive messages, or obscene content.
• Buying Prohibited or Restricted Goods: Attempting to buy/sell banned products (weapons, drugs, counterfeit goods, wildlife items, pirated software, etc..
• Multiple Accounts for Malicious Activity: Creating fake/multiple accounts to exploit discounts, referral bonuses, or cashback schemes.
• Identity Theft: Using stolen Aadhaar, PAN, mobile numbers, or banking details to create accounts or shop.
• Spamming or Phishing Attempts: Sending fake links, phishing emails, or trying to steal the credentials of other users through platform misuse.
• Illegal File/Data Sharing: Uploading or sharing pirated content, copyrighted material, or restricted data via the platform.
• Violation of Age-Restricted Purchases: Misrepresenting age to buy alcohol, tobacco, adult products, or other restricted items.

• Harassment of Delivery Personnel / Logistics Staff: Abusive behavior, threats, or assault against delivery partners.

  Any user found engaging in the mentioned prohibited activities or any other unlawful activity, as defined by the laws and regulations of the Government of India, will have their account suspended and may also be subject to legal action.  

5. Vendor Obligations

Vendors registered on our Platform must:

• Maintain valid licenses and qualifications as required by law.
• Deliver high-quality services as per industry standards.
• Not misrepresent their expertise or experience.
• Comply with our cancellation, refund, and dispute resolution policies.
• Obligation to disclose pricing, GST, and correct product info.
• Take full responsibility for customer disputes (returns, warranties). 

*Note: All vendors are solely responsible for product warranties, statutory compliance (GST, consumer protection laws), and post-sale service.    

6. Booking & Payments

• Users can book services through the Platform by selecting a preferred Vendor.
• Payments may be collected online through secure gateways or directly by the Vendor, depending on the service.
• The Company may charge a platform fee or commission from the Vendor.
• Hazra Solutions does not store or retain any sensitive payment information, including but not limited to debit/credit card numbers, CVV codes, UPI IDs, or wallet credentials. All payment processing is handled by authorized, PCI-DSS certified payment gateways.
• All online transactions carried out through our platform are processed in strict compliance with globally recognized security frameworks, including the Payment Card Industry Data Security Standard (PCI-DSS), and with applicable guidelines and circulars issued by the Reserve Bank of India (RBI) governing UPI, digital wallets, and online payment systems.
• Users are advised to ensure the confidentiality of their payment credentials (e.g., OTP, PIN, UPI password). Hazra Solutions shall not be held liable for any unauthorized use of payment details caused by user negligence or third-party compromise.    
   

7. Terms of Use  

The following are the terms and conditions every member of this website, vendor, and customer is bound to follow.       

• Acceptance of Terms: By accessing or using https://hazrasolutions.in/ , you confirm that you have read, understood, and agreed to all the terms of use, our privacy policy, refund policy, etc., published on our website.     
• Eligibility: To create an account on our website, you must be at least 18 years of age or accessing the website under adult supervision.     
• User Account: You can create an account or use the website as a guest user to buy the listed products. Users are solely responsible for maintaining the confidentiality of their accounts and their details, and all activities are done through the account.
• Product Listings and Pricing: We can change or update product descriptions, prices, and availability, subject to change without prior notice. We make every effort to display accurate information, but do not guarantee the accuracy, completeness, or reliability of any product listing.    
• Order Acceptance and Cancellation: Hazra Solutions reserves all rights to refuse or cancel any order for reasons including, but not limited to, product availability, errors in product or pricing information, or problems identified by our payment department.    
• Third-Party Sellers: Hazra Solutions is not responsible for the quality, safety, legality, or availability of the products offered by third-party sellers listed on our website. All grievances related to quality, safety, and legality are directed to the seller.
• Use of the Website: By creating an account or using this website as a guest user, you agree not to misuse the website in any way, including but not limited to transmitting harmful software, engaging in fraudulent activities, or violating intellectual property rights.    
• Intellectual Property: All website content on https://hazrasolutions.in/, including logos, images, product descriptions, and designs, is owned by or licensed to Hazra Solutions and is protected by applicable intellectual property laws of the government of India. Illegal activity or misuse can lead to legal proceedings.    
• Limitation of Liability: https://hazrasolutions.in/ shall not be liable for any indirect, incidental, or consequential damages resulting from the use of or inability to use our services.    
• Amendments: We reserve the right to modify these Terms and Conditions at any time without prior notice. Continued use of the website signifies your acceptance of the updated terms.
• Account Suspension/Termination: We reserve the right to suspend, restrict, or permanently terminate any user account found to be in violation of our Terms of Use, policies, or applicable laws of India. Misuse includes, but is not limited to, unauthorized resale of products, spamming, fraudulent transactions, use of automated bots, or any unlawful activities. 
• Dispute Resolution Mechanism: In the event of any dispute, controversy, or claim arising out of or relating to the use of our platform or services, the following dispute resolution process shall apply:
  • Mediation: Parties shall first attempt to resolve the matter amicably through good-faith discussions and mediation.
  • Arbitration: If mediation fails, the dispute shall be referred to arbitration under the provisions of the Arbitration and Conciliation Act, 1996. The arbitration proceedings shall be conducted in English, and the venue shall be Kolkata, India. 
  • Courts: Subject to the above, the courts located in Kolkata, India, shall have exclusive jurisdiction over any disputes, and Indian law shall apply.  
• Force Majeure: Hazra Solutions Pvtd Ltd. shall not be held liable or responsible for any failure or delay in performance of our obligations arising out of or caused by events beyond our reasonable control. Such events may include, but are not limited to, acts of God, natural disasters, pandemics, strikes, lockouts, labor disputes, war, terrorism, government restrictions, power failures, or disruptions in communication systems. During such events, our obligations shall be suspended for the duration of the Force Majeure event, and we shall make reasonable efforts to resume services as soon as practicable.    
   

8. Limitation of Liability

• The Company is not responsible for the quality, safety, or legality of services provided by Vendors.
• We do not guarantee the availability or performance of any Vendor.
• Our liability is limited to the amount of service fee (if any) charged by us for using the Platform.  
   

9. Intellectual Property

All content on the Platform, including trademarks, logos, and text, is owned by Hazra Solutions Users and Vendors are prohibited from copying or using our intellectual property without permission.

10. Termination

We reserve the right to suspend or terminate any User or Vendor account if found violating these Terms & Conditions.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes arising will be subject to the jurisdiction of courts in Kolkata West Bengal.

12. Amendments

We may update these Terms & Conditions from time to time. Continued use of the Platform after such updates signifies your acceptance of the revised terms.
